This website, www.gmmodular.com ("Website") operated by GM Modular Private Limited and its subsidiaries or affiliates (hereinafter collectively referred to as “GM”, "We", "Us", or "Our"). By accessing or using the Website, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any other rules posted on the Website. These Terms govern your use of the Website and related services.

  1. Definitions

  • Personal Data: Any information relating to an identified or identifiable individual, as defined under the Digital Personal Data Protection Act, 2023 ("DPDP Act").

  • Services: Functions, facilities, information, promotions, or other services provided through the Website, including downloading images, screensavers, wallpapers, general news, and information.

  • User: Any individual who accesses or uses the Website after registering and obtaining authorization from GM.

  • Enabling downloads of images, screensavers, wallpapers, and other GM Modular products.

  • You must provide accurate, complete, and current information during registration and update it promptly if it changes.

  • Upon successful registration, you may receive a password or OTP to access the Services. You are responsible for maintaining the confidentiality of your password and account credentials.

  • GM reserves the right to reject, suspend, or terminate any User account if the provided information is inaccurate, incomplete, or violates these Terms or applicable laws.

User-Generated Content

  • The Website may include bulletin boards or communication platforms where Users can post content. All posted content is subject to GM’s review and approval.

  • GM reserves the right to remove any content deemed inappropriate, offensive, or unrelated to GM Modular products without prior notice.

  • User-generated content does not reflect GM’s views or opinions.

Termination of Services

  • GM reserves the right to terminate or suspend a User’s account at its discretion if the User misuses the Website or engages in unlawful or inappropriate conduct.

  • The Website is an additional, voluntary, and free service. GM may restrict or discontinue these services at any time without prior notice.

Duties of the User

  • You must provide true, accurate, and complete information during registration and promptly notify GM of any changes via the Website.

  • Access to the Website is restricted to authorized Users. Sharing account credentials or enabling access for unauthorized third parties is prohibited.

  • You are responsible for maintaining the confidentiality of your password and account.

  • You must not upload, modify, or corrupt the GM system or make it available to third parties. You agree to indemnify GM against claims arising from incorrect or unauthorized data provided by you.

  • To protect your personal information and ensure the security of your account, you are strictly advised not to share your One-Time Password (OTP), passwords, or any other authentication credentials with any person, including individuals claiming to represent our organization.

  • We will never request your OTP via phone call, email, SMS, or any third-party communication platform. Sharing your OTP with others may lead to unauthorized access to your personal data or financial information, and we will not be responsible for any loss or damage arising from such unauthorized disclosure.

  • If you suspect any suspicious activity or receive a request for your OTP, please report it to us immediately at Customer Care. 

  • We ensure that any third party receiving your data adheres to the DPDP Act’s requirements.

  • We will address complaints within the timelines prescribed by the DPDP Act (typically 30 days).

  • If unresolved, you may approach the Data Protection Board of India.

  1. Modifications to Terms

  • GM reserves the right to modify these Terms at any time. Changes will be posted on the Website.

  • Continued use of the Website after changes constitutes acceptance. To object, notify GM in writing within 30 days, after which GM may terminate your account.

  1. Public Notice

  • Beware of fraudulent communications (e.g., lotteries, sweepstakes) misusing GM’s name or trademarks. GM is not associated with such activities and is not liable for any resulting losses.

  • Report suspicious communications to our Grievance Officer.

  1. Applicable Law and Jurisdiction

  • These Terms are governed by the laws of India.

  • Disputes will be resolved through negotiation. Unresolved disputes must be notified to GM within 45 working days and will be subject to the exclusive jurisdiction of courts in Mumbai, India.

  1. Limitation of Liability

  • GM’s liability for claims arising from the Website or Services is limited to the points or amount credited to your wallet.

  • GM is not liable for indirect, consequential, or incidental losses, including loss of revenue, business, or profits, or for issues beyond our control (e.g., natural disasters, governmental actions).
